Butta Cakes Inc. d/b/a Lucharitos ("Lucharitos," "we," "us" or "our") respects your privacy. This Privacy Policy explains what information we collect when you visit lucharitos.com (the "Site"), order from us, sign up for our marketing messages or otherwise interact with us, and how we use, share and protect that information.

By using the Site or providing your information to us, you agree to the practices described in this Privacy Policy.


1. Information We Collect

Information you provide to us. We collect information you choose to share with us, including when you:

  • Sign up for our email or text message lists
  • Submit a catering, event or Taco Trailer inquiry
  • Contact us through a form, email or phone
  • Place an order, purchase a gift card or buy merchandise
  • Enter a promotion, giveaway or loyalty program

This information may include your first and last name, email address, mobile phone number, birthday, preferred Lucharitos location, event details and any other information you include in a message to us.

Information collected automatically. When you visit the Site, we and our service providers may automatically collect certain information about your device and visit, such as your IP address, browser type, device type, pages viewed, links clicked, referring website and the date and time of your visit. We collect this information using cookies, pixels and similar technologies described in Section 6.

Information from third parties. We may receive information about you from the third-party platforms we use to run our business, such as online ordering, catering, gift card, loyalty and social media platforms, when you interact with Lucharitos through those services.

2. How We Use Your Information

We use the information we collect to:

  • Process and fulfill orders, catering requests and event bookings
  • Respond to your questions, feedback and inquiries
  • Send you marketing emails and text messages you have agreed to receive, including specials, events, new location announcements and birthday offers
  • Personalize your experience, including sending offers relevant to your preferred location
  • Operate, maintain and improve the Site and our services
  • Measure the effectiveness of our marketing and advertising
  • Protect against fraud, unauthorized activity and security issues
  • Comply with applicable laws and enforce our policies

3. Email Marketing

If you subscribe to our email list, we will send you news, specials, event invitations and other promotional content from Lucharitos. You can unsubscribe at any time by clicking the "unsubscribe" link at the bottom of any marketing email or by contacting us using the information in Section 13. After you unsubscribe, we may still send you non-promotional messages related to an order, inquiry or request you made.

4. Text Message (SMS) Program

SMS marketing services are provided by Butta Cakes Inc. d/b/a Lucharitos Greenport, 119 Main Street, Greenport, NY 11944, on behalf of all Lucharitos locations.

You opt in to our text message program by giving your mobile number on a Lucharitos sign-up or offer form and agreeing to receive text messages. This includes offer forms reached through our Facebook and Instagram ads. When you opt in, you agree to receive recurring automated marketing and informational text messages from Lucharitos at the number you provide. These messages include coupon and offer delivery, specials, events and updates. Consent to receive text messages is not a condition of any purchase.

  • Message frequency varies.
  • Message and data rates may apply. Check with your wireless carrier for details about your plan.
  • To opt out, reply STOP to any message. You will receive one final message confirming that you have been unsubscribed. No further messages will be sent unless you opt in again.
  • For help, reply HELP to any message or contact us using the information in Section 13.
  • Wireless carriers are not liable for delayed or undelivered messages.
  • Full program terms are available in our [Terms of Service].

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information may be shared with subcontractors that support our text message program, such as messaging platform and customer service providers. All other categories of sharing described in this Privacy Policy exclude text messaging originator opt-in data and consent. This information will not be shared with any third parties.

5. How We Share Your Information

We do not sell, rent or trade your personal information to third parties.

We share your information only in the following limited circumstances:

  • Service providers. We work with trusted companies that help us operate our business, such as website hosting, email and text message delivery, customer relationship management, online ordering, catering, payment processing, gift cards and analytics. These providers may access your information only to perform services on our behalf and are required to protect it.
  • Lucharitos locations. We may share your information with the Lucharitos location you select or order from so that location can fulfill your order or respond to your inquiry.
  • Legal requirements. We may disclose information when we believe it is required by law, subpoena or other legal process, or when necessary to protect the rights, property or safety of Lucharitos, our guests or others.
  • Business transfers. If Lucharitos is involved in a merger, acquisition, sale of assets or similar transaction, your information may be transferred as part of that transaction, subject to this Privacy Policy.
  • With your consent. We may share your information for any other purpose with your permission.

The sharing described in this section does not apply to text messaging opt-in data and consent, which is governed by Section 4.

6. Cookies and Tracking Technologies

We and our service providers use cookies, pixels, tags and similar technologies to help the Site function, remember your preferences, understand how visitors use the Site and measure the performance of our marketing.

We may use third-party analytics and advertising tools, such as Google Analytics and the Meta Pixel, to understand Site traffic and to show you relevant Lucharitos ads on other websites and social media platforms. These providers may collect information about your use of the Site over time and across other websites.

You can control or delete cookies through your browser settings. Disabling cookies may affect how some features of the Site work. You can learn more about opting out of interest-based advertising at optout.aboutads.info and www.networkadvertising.org/choices.

Do Not Track. Some browsers offer a "Do Not Track" setting. Because there is no common industry standard for these signals, the Site does not currently respond to them.

7. Third-Party Services and Links

The Site contains links to and features from third-party services, including online ordering, catering (EZCater), gift card, merchandise and social media platforms. When you use those services, the third party's own privacy policy and terms apply. We are not responsible for the privacy practices of third-party websites or services, and we encourage you to review their policies.

8. Data Security

We use reasonable administrative, technical and physical safeguards to protect your personal information from loss, misuse and unauthorized access. However, no website, internet transmission or electronic storage system is completely secure, and we cannot guarantee absolute security. Payment information entered on third-party ordering and payment platforms is processed by those providers and is not stored by Lucharitos.

9. Data Retention

We keep your personal information only as long as needed for the purposes described in this Privacy Policy, such as maintaining your subscription, fulfilling orders or meeting legal, tax and accounting requirements. When we no longer need your information, we delete or de-identify it.

10. Your Choices and Rights

You may at any time:

  • Unsubscribe from marketing emails using the link in any email
  • Opt out of text messages by replying STOP
  • Request access to the personal information we hold about you
  • Request that we correct or update your information
  • Request that we delete your personal information, subject to legal exceptions

Depending on where you live, you may have additional rights under state privacy laws. To make a request, contact us using the information in Section 13. We will verify your identity before responding and will not discriminate against you for exercising your privacy rights.

11. Children's Privacy

The Site is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected information from a child under 13, we will delete it. If you believe a child has provided us with personal information, please contact us.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will post the updated version on this page and change the Effective Date above. Your continued use of the Site after changes are posted means you accept the updated Privacy Policy.
