These Terms of Service ("Terms") govern your use of lucharitos.com (the "Site") and the Lucharitos text message program, offered by Butta Cakes Inc. d/b/a Lucharitos ("Lucharitos," "we," "us" or "our"). By using the Site or opting in to our text messages, you agree to these Terms and to our [Privacy Policy].

1. Use of the Site

You may use the Site for personal, non-commercial purposes in accordance with these Terms. You agree not to misuse the Site, interfere with its operation or attempt to access it through any means other than the interface we provide.

2. Text Message (SMS) Program Terms

Program description. The Lucharitos text message program sends recurring automated marketing and informational messages, including coupon and offer delivery, specials, events and updates. SMS marketing services are provided by Butta Cakes Inc. d/b/a Lucharitos Greenport, 119 Main Street, Greenport, NY 11944, on behalf of all Lucharitos locations.

Opting in. You opt in by giving your mobile number on a Lucharitos sign-up or offer form and agreeing to receive text messages. Consent to receive text messages is not a condition of any purchase.

  • Message frequency varies.
  • Message and data rates may apply. Check with your wireless carrier for details about your plan.
  • To opt out, reply STOP to any message. You will receive one final message confirming that you have been unsubscribed. No further messages will be sent unless you opt in again.

  • Wireless carriers are not liable for delayed or undelivered messages.
  • You agree to notify us if you change or deactivate the mobile number you used to opt in.

Your mobile information is handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

3. Promotions, Offers and Coupons

Offers and coupons are subject to the terms stated on each offer. Unless otherwise stated, offers are limited to one per guest, valid only at participating Lucharitos locations during the stated period, not redeemable for cash and not combinable with other offers. Lucharitos may modify or end any promotion at any time and may refuse redemption of any offer that has been copied, altered or obtained in violation of these Terms.

4. Menus, Pricing and Availability

Menu items, prices, hours and availability may vary by location and are subject to change without notice. We make reasonable efforts to keep Site information accurate, but we do not guarantee that all information is complete or current.

5. Orders, Gift Cards and Third-Party Services

Online ordering, catering, gift card and merchandise purchases are processed through third-party platforms. Those purchases are governed by the terms and policies of the applicable provider. Lucharitos is not responsible for the content, availability or practices of third-party services.

6. Intellectual Property

The Lucharitos name, logos, photography, menus and other Site content are owned by or licensed to Lucharitos and are protected by intellectual property laws. You may not copy, reproduce or use this content for commercial purposes without our written permission.

7. Disclaimers

The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.

8. Limitation of Liability

To the fullest extent permitted by law, Lucharitos will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or the text message program.

9. Indemnification

You agree to indemnify and hold harmless Lucharitos and its owners, employees and agents from any claims arising from your misuse of the Site or your violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute will be resolved in the state or federal courts located in Suffolk County, New York.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and change the Effective Date above. Your continued use of the Site or text message program after changes are posted means you accept the updated Terms.
